Key findings
The report analyses several cases of hate speech targeting Muslims in Croatia, its occurrence and the accuracy of procedural classifications of the criminal factors coupled with the hate crime (inciting to hate and / or inciting to violence).
Methodology (Qualitative/Quantitative and exact type used, questionnaires etc)
The research data consisted of analysing all acts of hate speech committed in the period from 2016 to 2021, proceedings for which were finally concluded by a decision of the competent body of the proceedings (the State Attorney's Office or the court).
Sample details and representativeness
The study analysed 59 criminal cases, 41 dismissals, and 20 misdemeanour cases. Criminal cases represent the entire population of finally adjudicated hate speech cases under Article 325 of the Criminal Code 2016–2021. The samples for dismissals and misdemeanours were selected based on temporal and territorial representativeness and refined due to data quality issues. Stratified and random sampling was used where possible. Two independent coders analysed each case, ensuring reliability and consistency.
